1. Agreement to Terms

By accessing or using Offcam ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We may modify these Terms at any time, and your continued use constitutes acceptance of any changes.

2. Description of Service

Offcam is an AI-powered platform that generates faceless videos from text prompts. The Service includes video generation, AI voiceovers, automated captions, and related features. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

3. Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

You must be at least 13 years old to use the Service. If you are under 18, you must have parental consent.

4. Subscription Plans and Billing

Plans

We offer Creator, Pro, and Agency subscription plans with different video limits and features. Plan details and pricing are available on our pricing page.

Billing

Subscriptions are billed monthly or annually in advance. By subscribing, you authorize us to charge your payment method on a recurring basis. All fees are in USD and non-refundable.

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access until then. No refunds are provided for partial periods.

Plan Changes

Upgrades take effect immediately with pro-rated billing. Downgrades take effect at the start of your next billing cycle.

5. Acceptable Use

You agree not to use the Service to:

  • Create content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Generate content that infringes on intellectual property rights of others
  • Create deepfakes or misleading content designed to deceive viewers about real people or events
  • Produce content that sexualizes minors or depicts child exploitation
  • Generate spam, phishing content, or malware
  • Violate any applicable laws or regulations
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any part of the Service
  • Use automated systems to access the Service without permission (except via our API for authorized users)
  • Resell or redistribute the Service without authorization

We reserve the right to suspend or terminate accounts that violate these terms.

6. Content Ownership and License

Your Content

You retain ownership of the text prompts and topics you submit. By using the Service, you grant us a license to process your inputs to generate videos.

Generated Videos

Videos generated through the Service are owned by you. You may use them for personal or commercial purposes, including social media, marketing, and client work. You are responsible for ensuring your use complies with applicable laws and platform terms.

Stock Media

Generated videos may include stock footage, images, and music. These are licensed for use within videos created through our Service. You may not extract or use these assets separately.

AI Voices

AI-generated voices are licensed for use in videos created through the Service. Voice cloning features (where available) may only be used with voices you have the right to clone.

7. Intellectual Property

The Service, including its design, features, code, and branding, is owned by Offcam and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY CONTENT GENERATED.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OFFCAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Offcam and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your content, or your violation of these Terms.

11. Termination

We may terminate or suspend your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
